1. About Bierfahne

Bierfahne is an independently operated U.S. online retail store offering footwear to customers through the Site.

Our store is hosted on Shopify, which provides the e-commerce platform and checkout technology used to offer the Services.

2. Policies Incorporated into These Terms

The following policies form part of these Terms:

• Shipping Policy
• Return and Refund Policy
• Privacy Policy
• Payment Policy

If a specialized policy conflicts with these Terms concerning its specific subject matter, the specialized policy will control to that extent. Transaction-specific information displayed during checkout or included in an order confirmation also applies to the relevant order.

3. Eligibility and Customer Accounts

By using the Services, you represent that you are at least the age of majority in your place of residence or are using the Services with the involvement and consent of a parent or legal guardian.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activities conducted through your account.

You agree to provide current, complete, and accurate account, billing, shipping, and contact information. Please notify us promptly if you believe your account has been accessed without authorization.

4. Permitted Use of the Site

You agree not to:

• Use the Site or Services for unlawful or fraudulent purposes
• Provide false, misleading, or unauthorized payment information
• Attempt to interfere with the Site’s operation or security
• Introduce malware, harmful code, or automated attacks
• Attempt to gain unauthorized access to accounts or systems
• Unlawfully collect personal information from the Site

We may restrict access, refuse service, or cancel an affected order when reasonably necessary to protect customers, Bierfahne, our service providers, or the security and lawful operation of the Site.

5. Product Information and Footwear Sizing

We make reasonable efforts to present product names, descriptions, materials, colors, sizes, prices, availability, and images accurately.

Actual colors may appear slightly different depending on screen settings, lighting, photography, and reasonable production variations. Footwear fit may vary by design, material, shape, and construction.

Customers should review the product description and product-specific sizing information before ordering. If a product page contains a separate size chart, that chart should be used instead of a general size-conversion guide.

If you receive a product that is materially different from your order, damaged, or defective, contact us under our Return and Refund Policy.

6. Prices, Taxes, and Promotions

Unless another currency is expressly displayed at checkout, prices are listed in United States Dollars (USD).

Applicable discounts, shipping charges, and taxes will be displayed during checkout before the customer submits the order. Bierfahne does not add undisclosed charges after an order has been placed.

Prices and promotions may change before an order is submitted. A price change will not be applied retroactively to a completed purchase unless required by law or agreed to by the customer.

Promotional offers may be subject to stated eligibility requirements, expiration dates, product exclusions, or quantity limits. Promotions cannot be combined unless expressly stated.

7. Orders and Order Acceptance

Placing an order constitutes an offer to purchase the selected products. An Order Confirmation acknowledges that we received the order but does not by itself guarantee final acceptance, product availability, or shipment.

Bierfahne may review, decline, or cancel an order because of:

• Product unavailability
• An obvious pricing or product-information error
• An unsuccessful or declined payment
• Suspected fraud or unauthorized activity
• Incomplete or materially inaccurate order information
• A legal or shipping restriction affecting the order

If an error affects the price or another material term, we may contact the customer and allow the customer to confirm the corrected terms or cancel the order. We will not charge a higher corrected price without customer authorization.

If Bierfahne cancels an order after payment has been captured, the applicable refund will be issued to the original payment method.

8. Accuracy of Order Information

Customers are responsible for reviewing their order information before submitting payment, including:

• Recipient name
• Shipping and billing addresses
• Email address and telephone number
• Product, footwear size, color, and quantity

If you identify an error after placing an order, contact us as soon as possible. We will make a reasonable effort to assist, but changes cannot be guaranteed after fulfillment or shipment has begun.

Any additional cost caused by customer-provided address errors will be disclosed before a reshipment is arranged. Bierfahne will not charge an undisclosed reshipping fee.

9. Payment Terms

Available payment methods and payment-related terms are described in our Payment Policy.

By submitting payment information, you represent that you are authorized to use the selected payment method and that the information provided is accurate.

Payments are processed through Shopify and supported payment providers. Bierfahne does not store complete credit card or debit card numbers on its website or servers.

An order will not proceed to fulfillment or shipment unless its payment status permits processing.

10. Shipping and Delivery

Processing times, shipping methods, delivery estimates, shipping costs, and tracking information are described in our Shipping Policy.

Delivery dates are estimates rather than guaranteed arrival dates. Weather, carrier disruptions, address problems, public emergencies, and other events outside our reasonable control may affect delivery.

If an order cannot be shipped within the promised timeframe, Bierfahne will provide any delay notice, cancellation option, or refund required by applicable law.

Nothing in this section removes any non-waivable right or remedy available for non-delivery, loss, or another shipping issue.

11. Returns, Refunds, and Exchanges

Bierfahne accepts eligible return requests submitted within 30 calendar days after delivery, subject to the conditions in our Return and Refund Policy.

Bierfahne does not charge a restocking fee. Return-shipping responsibility depends on the reason for the return:

• Customers pay return shipping for buyer’s-remorse returns, including change of mind, size selection, fit, color, or style preference
• Bierfahne pays the applicable return-shipping cost for an incorrect, damaged, or confirmed defective product

Approved refunds are issued to the original payment method. The customer’s financial institution may require additional time to post the refund after Bierfahne issues it.

12. Order Cancellations

Customers may request cancellation by contacting us as soon as possible. We will make a reasonable effort to cancel an order before it enters fulfillment or shipment, but cancellation cannot be guaranteed.

If the order has entered fulfillment or has shipped, it may no longer be canceled. After delivery, the customer may request an eligible return under our Return and Refund Policy.

If a successfully paid order is canceled, the applicable refund will be issued to the original payment method.

13. Intellectual Property

Site content—including text, graphics, logos, page design, photographs, product descriptions, icons, and software—is owned by Bierfahne, licensed to Bierfahne, or otherwise used with authorization, and is protected to the extent provided by applicable intellectual property law.

You may access and use the Site for personal, non-commercial shopping purposes. You may not reproduce, modify, distribute, sell, publish, or commercially exploit protected Site content without permission from the applicable rights holder.

Third-party names, trademarks, and content remain the property of their respective owners. Their appearance does not imply sponsorship or affiliation unless expressly stated.

14. Reviews, Feedback, and Submitted Content

If you submit a review, photograph, suggestion, or other content, you represent that you have the right to submit it and that it does not violate applicable law or another person’s rights.

You grant Bierfahne a non-exclusive, worldwide, royalty-free license to use, reproduce, display, and adapt submitted content for operating, improving, and promoting the Services, subject to our Privacy Policy and applicable law.

We may decline or remove content that is unlawful, fraudulent, threatening, infringing, misleading, or unrelated to the products or Services. We will not knowingly alter a genuine customer review to misrepresent the customer’s opinion.

15. Third-Party Services and Links

The Services may rely on third parties for hosting, checkout, payments, fulfillment, shipping, analytics, advertising, security, and other operational functions.

Third parties operate under their own terms and privacy policies. Bierfahne does not control and is not responsible for the independent content or practices of third-party websites and services.

A link to a third-party service does not by itself constitute an endorsement or affiliation.

16. Privacy

Personal information collected through the Services is handled as described in our Privacy Policy.

Available cookie and data-sharing choices can be managed through our Your Privacy Choices page and other privacy controls displayed on the Site.

17. Errors, Availability, and Site Changes

We may correct typographical errors, inaccuracies, or omissions and update Site information when reasonably necessary.

We may modify, suspend, or discontinue a non-essential Site feature. These changes will not remove obligations relating to an order Bierfahne has already accepted.

If an ordered product becomes unavailable, we will contact the customer and provide an appropriate cancellation, refund, substitution choice, or other resolution. We will not substitute a materially different product without customer agreement.

18. Disclaimer of Warranties

To the extent permitted by applicable law, the Site and its general content are provided on an “as available” basis. We do not guarantee that the Site will always operate without interruption or that every non-material error will be corrected immediately.

Nothing in these Terms excludes or limits an express product commitment, published return right, or warranty that cannot lawfully be excluded.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions in this section apply only to the extent permitted by law.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Bierfahne will not be liable for indirect, incidental, special, exemplary, or consequential losses arising from the use of the Site or Services when those losses were not reasonably foreseeable.

Where legally permitted, Bierfahne’s total liability arising from a specific order will not exceed the amount paid to Bierfahne for that order.

Nothing in these Terms limits or excludes liability for fraud, willful misconduct, gross negligence, personal injury caused by negligence, or any liability or consumer right that cannot lawfully be limited or excluded.

Some jurisdictions do not allow certain limitations of liability. In those jurisdictions, these limitations apply only to the extent permitted by law.

20. Events Beyond Reasonable Control

Bierfahne will not be responsible for delay or failure caused by events beyond our reasonable control, including severe weather, natural disasters, carrier disruptions, government action, widespread network failures, labor disruptions, or public emergencies.

We will make reasonable efforts to communicate material delays and provide available remedies. This section does not remove any refund, cancellation, or other right that cannot be waived under applicable law.

21. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

Before beginning formal proceedings, we encourage customers to contact us so we can attempt to resolve the issue directly. This informal process does not prevent a customer from exercising a legal right, contacting a payment provider, or using another remedy available under applicable law.

Any unresolved dispute may be brought before a court of competent jurisdiction. If the law of the customer’s state provides mandatory consumer protections or another permitted location for a claim, those non-waivable protections remain available.

22. Severability, Waiver, and Assignment

If a provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

A failure to enforce a provision does not waive the right to enforce it later.

You may not assign rights or obligations under these Terms without our prior written consent. Bierfahne may assign these Terms as part of a lawful business transfer, subject to applicable consumer and privacy laws.

23. Changes to These Terms

We may update these Terms to reflect changes in the Services, business practices, technology, or legal obligations.

Updated Terms will be posted on this page with a revised “Last Updated” date. Material changes will apply prospectively unless applicable law requires otherwise.

An order will generally remain subject to the Terms and policies in effect when the order was placed, except where a later change is required by law or is more favorable to the customer.

24. Entire Agreement

These Terms, the policies incorporated by reference, and applicable transaction-specific information constitute the agreement between the customer and Bierfahne concerning the Services and applicable order.
